Supreme Court to Rule on Tinubu’s Disqualification Suit December 16
The Supreme Court is set to deliver a judgment on Monday, December 16, regarding a fresh legal challenge seeking the removal of President Bola Tinubu from office.
The case, identified as SC/CV/667/2023, calls for the apex court to disqualify Tinubu on two main allegations: lack of constitutional eligibility to serve as Nigeria’s President and unlawfully occupying the office in contravention of national laws.
The suit was filed by Chief Ambrose Albert Owuru, a 2019 presidential candidate under the Hope Democratic Party (HDP).
Listed as defendants in the case are former President Muhammadu Buhari, the Attorney General of the Federation and Minister of Justice, the Independent National Electoral Commission (INEC), and Tinubu, designated as the 1st to 4th respondents.
Owuru, a British-trained lawyer admitted to the Nigerian Bar in 1982, claims he won the 2019 presidential election but was denied his mandate, which he alleges was unlawfully held by Buhari throughout his tenure. He further argues that a prior suit he filed to challenge Buhari’s presidency was sidetracked by the Supreme Court due to scheduling errors.
Additionally, Owuru wants the Supreme Court to declare Tinubu unfit to hold the presidency, citing his alleged forfeiture of $460,000 to U.S. authorities over a purported drug-related offence.
Owuru also accused Tinubu of being an operative of the CIA, alleging that this role disqualifies him from holding public office in Nigeria.
In his prayers, Owuru is asking the court to recognize him as the legitimate winner of the 2019 election, nullify Tinubu’s presidency, and order his immediate swearing-in to reclaim his alleged stolen mandate.
The Supreme Court has confirmed the hearing for Monday, December 16.
The hearing notice states:
“Please kindly take note that SC/CV/667/2023 Chief Ambrose Albert Owuru & Anor VS President Muhammadu Buhari & 3 Ors at the Supreme Court of Nigeria sitting at Abuja is slated for the hearing of motions on Monday 16/12/2024.
“Thanks, Ukor Michael Akan, for: the Hon. Chief Registrar.”
According to DAILY POST, the hearing notice has been served on Tinubu via the Office of the Attorney General of the Federation and Minister of Justice.
Sources suggest that Chief Wole Olanipekun, SAN, may lead Tinubu’s defense in court.

It is worth noting that Owuru had previously been fined N40 million by the Court of Appeal for filing what was deemed a frivolous suit against Tinubu, INEC, and others.
As of the time of filing this report, it is unclear whether Owuru has paid the fine before initiating the current legal action.
